On September 4, 2025, Executive Order 14345 was signed to implement the United States-Japan Agreement. This executive order, issued under IEEPA and Section 232, establishes a baseline 15% tariff on nearly all Japanese imports, along with special provisions for automobiles, auto parts, and civil aircraft.

Effective Date:

Applies to Japanese goods entered or withdrawn for consumption on or after August 7, 2025.

New HTS codes went live in ACE on September 16, 2025.

General Reciprocal Tariff:
-
If the standard duty rate is 15% or higher, no additional reciprocal tariff applies.

If the standard duty rate is below 15%, the combined total duty is set to 15%.

Importers must update filings to use the new HTS structure and correct entries retroactively as needed.

Civil Aircraft:

Civil aircraft and related parts from Japan are exempt from IEEPA reciprocal and Section 232 tariffs effective September 16, 2025.

Automobiles & Auto Parts:

≥15% duty rate: No additional Section 232 duty.

<15% duty rate: Combined duty equals 15%.

Exemptions:
-
Certain categories, including products already covered by Section 232 measures (aluminum, steel, copper, and certain vehicles), remain exempt from reciprocal tariffs.

Other exemptions, such as pre-shipment dates or goods with U.S. content, continue to apply.

Action for Importers:

Update entries to reflect new HTS codes for goods entered on or after August 7, 2025.

For entries where duties were already paid, Post Summary Corrections (PSC) or protests may be filed to request refunds.
