Re: Force Majeure due to International Longshoreman’s Association Strike/Lockout
We regret to inform you that Mallory Alexander International Logistics, LLC, dba Mallory Transportation System (“MTS”) has declared force majeure for all shipments in and out of the United States East and Gulf Coasts, due to the International Longshoremen’s Association (“ILA”) strike (the “Strike/Lockout”) which began on 12:01 a.m. ET of October 01, 2024. During the Strike/Lockout, the ILA will not handle or move any containers or cargo at the affected East and Gulf Coasts; cargo coming to, leaving, or moving within the affected East and Gulf Coasts will be subject to rail stoppage and, among other impacts, marine terminals are set to close. Delays and disruptions will also be expected for the transportation of all cargo due to challenges in ports not involved in the Strike/Lockout. MTS reserves all rights under MTS’s Bill of Lading Terms.
Ocean carriers that operate the vessels upon which MTS relies have declared Force Majeure due to the Strike/Lockout and may deliver containers to ports other than the port listed on the bill of lading. Carriers may also assess additional port disruption charges in delivering cargo to alternative ports. MTS will work with its impacted customers to coordinate ultimate delivery of the containers. MTS will pass through, without mark up, any applicable carrier surcharges and use its best efforts to provide estimates of costs to provide ultimate delivery.
