An executive order released Friday night (9/5/25) adjusts the scope of Annex II which lists goods that are not subject to IEEPA reciprocal tariffs. Certain products were removed from Annex II while other products were added. The revised version of Annex II is effective for goods entered for sale or withdrawn from a warehouse for sale on or after 9/8/25 (12:01am ET).

U.S. Customs and Border Protection (CBP) released CSMS # 66151866 with further instructions.

• Filing Instructions:

  • Importers must use HTSUS subheading 9903.01.32 when declaring exempt products.

  • For pre-filed entries covering affected products, corrections must be made within 10 days of cargo release from CBP custody.

• Future Updates:

  • Additional product exemptions may be added under framework or final trade agreements as determined by the Department of Commerce and USTR.

  • CBP will issue further CSMS updates as needed.
