Executive Order Suspending Duty-Free De Minimis Treatment

President Trump signed an Executive Order to suspend the duty-free de minimis exception for all countries under the International Emergency Economic Powers Act (IEEPA), effective August 29, 2025. All low-value shipments (previously duty-free if under $800) will be subject to all applicable duties, taxes, fees, exactions, and charges, regardless of value or mode of entry, except certain international postal shipments, which will follow a separate duty structure.

International postal shipments will be subject to one of two duty methods:

  • Ad valorem duty: A duty equal to the effective IEEPA tariff rate applicable to the country of origin of the product will be assessed on the value of each package containing goods for consumption.
  • Specific duty: A duty ranging from $80 per item to $200 per item, based on the effective IEEPA tariff rate applicable to the country of origin of the product. The specific duty methodology will be available for transportation carriers to select for a period of 6 months, after such time all shipments must comply with the ad valorem duty methodology.

Exemptions remain for:

  • Travelers: Up to $200 in personal items brought back duty-free.
  • Gifts: Gifts valued at $100 or less sent internationally remain duty-free.
